IMPORTANT: By installing, accessing, or using the
Software, you agree to this EULA. If you do not agree, do not
install or use the Software. The most current EULA is the one
shipped inside each release; that copy governs your installed
version.
1. Definitions
"Software" means the MeshThreader™ software and related components (including any desktop or mobile app, device UI software, firmware, updates, documentation, and any included modules), in object code form, and any accompanying materials.
"Services" means any hosted or online services, if applicable.
"You" means the individual or entity using the Software.
"Licensor" means Samuel Jaks, the owner and developer of MeshThreader™.
2. License grant (limited, revocable)
Subject to your compliance with this EULA, the Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software solely for your internal or personal use on device(s) you own or control.
3. Restrictions
You may not:
- copy, modify, or create derivative works of the Software except as expressly permitted by this EULA;
- reverse-engineer, decompile, or disassemble the Software except to the extent applicable law expressly permits;
- rent, lease, lend, sell, sublicense, or otherwise transfer the Software;
- remove or alter any proprietary notices on the Software;
- use the Software to develop a competing product;
- use the Software in violation of any applicable law or regulation.
4. Ownership & trademark
The Software is licensed, not sold. The Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights. No rights are granted other than those expressly stated in this EULA. MeshThreader™ is a trademark of the Licensor.
5. Updates
The Licensor may provide updates, patches, or new versions of the Software. Such updates are governed by the EULA shipped with that release. The Licensor is not obligated to provide updates or continued support.
6. Third-party components
The Software may include or interoperate with third-party open-source components, each of which is licensed under its own terms. Nothing in this EULA restricts your rights under those third-party licenses.
7. Privacy
The Software runs locally on your own device(s). The Licensor does not collect telemetry or personal data through the Software itself. If you contact the Licensor by email, the contents of your email and your email address are processed only to respond to you. Supporter code purchases through Ko-fi are processed by Ko-fi and its payment processor; the Licensor receives only the information necessary to send you your code (your name and email).
8. Terms of access
Access to downloads is granted by supporter code. Codes are issued upon tip via Ko-fi or by direct invitation from the Licensor. Codes are non-transferable. Sharing or publishing codes may result in code revocation. No refunds — tips support development of the Software, not the purchase of a license; the license granted in section 2 is what you receive.
9. Amateur radio compliance
If you use the Software to operate amateur radio equipment, you represent that you hold a valid amateur radio license for the jurisdiction in which you operate. You are solely responsible for compliance with all applicable amateur radio regulations, including (in the United States) FCC Part 97 rules. The Licensor is not responsible for any violations resulting from your use of the Software.
10. Export controls
You agree to comply with applicable export and sanctions laws and regulations.
11. Disclaimer of warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SOFTWARE. TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS EULA OR THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID FOR ACCESS TO THE SOFTWARE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD $100 IF YOU PAID NOTHING).
13. Termination
This EULA is effective until terminated. It terminates automatically if you breach it. Upon termination, you must stop using and uninstall or delete all copies of the Software. Sections 4, 11, 12, and 14 survive termination.
14. Governing law & venue
This EULA is governed by the laws of the United States and the state in which the Licensor resides at the time a dispute arises, excluding conflict-of-law rules. Any dispute will be brought in a state or federal court of competent jurisdiction where the Licensor resides, unless prohibited by applicable law.
15. Entire agreement
This EULA constitutes the entire agreement between you and the Licensor regarding the Software and supersedes all prior agreements.
